Legal Recognition of Electronic Signatures

Electronic forms, documents, records, communications, or transactions shall have legal recognition, admissibility, effect, validity, proof, and enforceability without the need for physical signatures or witnesses.

Requirement for Writing

Electronic forms satisfy the requirement for written documents under the law, provided they are accessible for subsequent reference.

Requirement for Original Form

Presenting or retaining electronic documents fulfills the requirement for the original form, even if not in physical format.

Client Responsibilities

  1. Clients must provide accurate information to certification service providers and promptly update any changes to avoid misleading or fraudulent use of electronic signatures
  2. Clients must adhere to the regulations governing electronic signatures, including the use of accredited certification service providers and security procedures

Liability and Penalties

  1. Providing false information, misuse of certificates, or allowing fraudulent use of electronic signatures are punishable by imprisonment or fines as per the Electronic Transactions Ordinance, 2002
  2. Clients may be required to pay compensation for damages resulting from misuse of electronic signatures, recoverable as arrears of land revenue.

E-Sign Consent Policy: This E-Sign Consent Policy outlines the terms and conditions for electronic signatures and transactions for customers in Canada and Pakistani customers dealing with Bizoso Consulta Pakistan, a partner company of Bizoso Consulta Canada, in accordance with the Canadian Electronic Commerce Act (CECA) and relevant Pakistani laws.

  • Electronic Signatures and Transactions: By electronically signing any document or clicking "I agree" on this platform, you acknowledge that your electronic signature is legally binding and holds the same validity as a handwritten signature under CECA and applicable Pakistani regulations.
  • Validity and Enforceability: Electronic signatures and records are considered valid and enforceable for all legal and business transactions, including contracts, agreements, consent forms, and any other documents requiring signatures.
  • Consent Documentation: Your electronic consent and signature will be documented electronically and securely stored in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada and relevant data protection laws in Pakistan.
  • Security Measures: Our platform employs robust security measures to protect electronic transactions, including encryption, access controls, secure storage protocols, and authentication mechanisms, as required by PIPEDA and Pakistani data protection regulations.
  • Cross-Border Data Transfer: As a customer dealing with Bizoso Consulta Pakistan, your electronic data, including signatures, may be transferred between Canada and Pakistan for processing and documentation purposes. This transfer will be done in compliance with data protection laws in both countries.
  • Revocation of Consent: You have the right to revoke your electronic consent at any time by contacting us directly. However, revocation may impact your ability to access certain services or documents electronically.
  • Dispute Resolution: In case of any dispute or legal challenge regarding electronic signatures or records, the provisions of CECA, PIPEDA, and relevant Pakistani laws will govern and determine the resolution process.
  • Acknowledgment of Terms: By proceeding with the electronic signature process or clicking "I agree," you confirm that you have read, understood, and agreed to abide by the terms and conditions outlined in this E-Sign Consent Policy.
  • Updates and Amendments: Bizoso Consulta reserves the right to update or amend this E-Sign Consent Policy as necessary. Any changes will be communicated to customers through appropriate channels.
